The SAC Smart Coaching (SAC SC) services including Smart Training Plan (STP), Smart Consultation Session (SCS), Smart PowerFit (SPF) and Smart Runner-FITSEA Packages (SRP) and its data and information collected through the services rendered to the clients are properties of the Smart Active Solutions (SAS) company. The SAS Management has the right to keep or dispose of the information at our discretion. We will practice data protection and confidentiality of all the clients information.

SAC Smart Coaching (SAC SC) may use any third party website and mobile platform to send out the Smart Training Plan (STP), collect data and analyses clients progress via the website linked to the Coaching account. Please note that SAC SC Terms and Conditions overrides and supersedes any third party website’s Terms of Use.

By purchasing the SAC SC services and products, you are deemed to be NOT in these industries; Fitness/Wellness Coaching, Running Event Organisers and related services. You have no intention to be a running coach and use our materials for coaching in the present time or in the future.

By purchasing and using our SAC SC services and products, you have limited rights to the publication of our coaching materials. The information contained in the plan can ONLY be view within the website link given upon purchase. Any re-write of the workouts to other public platforms such as your training app linked to your watch or phone, Facebook, Instagram, STRAVA, and others, is strictly prohibited.

Note that usage of our description of the specific workouts (with intervals and sets) and using our terms of P1 to P5 are infringements of our proprietary materials.

Failure to comply to the above will have your plan terminated and no fees will be refunded. The Management has the prerogative to NOT coach/train any client that refuses to cooperate and communicate on issues related to the services rendered.

INDEMNITY CLAUSE : By purchasing SAC SMART COACHING TRAINING PLANS AND SERVICES you will indemnify and hold harmless SAC Smart Coaching and Smart Active Solutions, and its subsidiaries, affiliates, officers, agents or other partners, users, Coaches, Sponsors and employees, from and against any claim, liability, loss, expense or demand, including reasonable attorneys' fees, relating to or arising out of your Content, your use of any other Content, your use of or connection to the Site and Services (including any information, materials, products or services available through the Site or Services), your violation of these Terms of Use, or your violation of any applicable laws or any rights of another user or third party.

Health Declaration and Responsibility : The purchasers of the SAC Smart Coaching Services must be fully responsible for their health and medical conditions upon using the services and will indemnify SAC Smart Coaching of any claims as per Item 8. INDEMNITY CLAUSE.
